The contrast between Donald Trump and President Joe Biden as far as the rule-of-law could not be more stark. Accountability has finally come for Steve Bannon for his two contempt of Congress convictions. On July 11th, Judge Juan Merchan will sentence Donald Trump on his 34 felony convictions. Just as is true in all criminal sentencing hearings, Judge Merchan will base his sentence in part, on whether Trump will take responsibility for his crimes. Indeed, after a conviction, accepting responsibility for one's crimes is the first step on the road to rehabilitation. If a defendant refuses to accept responsibility for his crimes, that suggests that he is not amenable to rehabilitation, and it generally will result in a longer prison term. We have nearly 300,000 unsolved murders in the United States. That's 300,000 families who sit by the phone waiting for a call to come from a detective saying, "we've got a break in your loved one's case." These calls almost never come. When I retired from the Department of Justice, after decades of prosecuting murder cases in Washington, DC, I was determined to do something about that, and I proposed the Homicide Victim's Families Rights Act ("HVFRA") to Congressman Eric Swalwell, himself a former prosecutor. He heard me out and led the charge in an effort to bring long-overdue hope and help to homicide families. In 2022, the HVFRA became law, and it provides that homicide families have a legal right to require the involved police department to review the homicide investigation of their loved one and, depending on the results of the review, a full reinvestigation by a new team of detectives. We are now in the process of pushing this federal law to the states as model legislation to help homicide families in all 50 states. And we need your help - homicide families need your help. It's difficult to understand how a defendant on pre-trial release in four criminal cases is still allowed to endanger the community by holding hate rallies that inspire violence. After more than 15 hours on the witness stand, Michael Cohen's testimony concluded. Although the defense attorney scored a couple points, Michael Cohen's testimony was consistent, corroborated and credible. Interestingly, Trump's lawyer, Todd Blanche, didn't even question Cohen about the 2017 Oval Office meeting that was key to the prosecution's case. Although this evidence is uncorroborated, the defense attorney will almost certainly argue in closing that the jury should take this evidence to the bank. On January 6th, 2021, Trump incited an insurrection, and as a result, he is pending federal prosecution for his attempt to overturn the results of the 2020 presidential election. Trump's angry mob showed their determination to "stop the steal" on January 6th by carrying upside-down American flags. Days later, Justice Samuel Alito's home was flying an upside-down American flag in what appeared to be solidarity with Trump's "stop the steal" efforts. There are now at least two Supreme Court justices who are disqualified from deciding January 6 cases: Alito and Clarence Thomas.
