Mark Latham's Homophobic Tweet Goes to Court
6/23/2023
Episode 317 - In this episode, we delve into a heated legal dispute involving independent MP Alex Greenwich and the controversial leader of NSW One Nation, Mark Latham. Greenwich has taken legal action against Latham, seeking aggravated damages on grounds of defamation. The incident stems from a tweet in which Latham made graphic and homophobic accusations, targeting Greenwich and his alleged involvement in what he described as "disgusting" sexual activities.
The tweet was posted by Mr Latham in March as a response to an earlier remark made by Mr Greenwich, who had referred to Latham as a "disgusting human being." This comment was made in the aftermath of an incident where LGBTQI protesters were assaulted outside a public forum where Latham was speaking.
Although Latham did delete the tweet shortly after, he staunchly refused to offer an apology. This refusal has escalated the matter, leading to a legal battle between the two prominent figures. Join us as we explore the nuances of this high-profile case, analysing the legal ramifications and potential implications for both individuals involved.

Labor’s Brittany Higgins Problem
6/13/2023
Episode 315 - Finance Minster, Katy Gallagher, may have misled Parliament on a crucial fact regarding her knowledge of the alleged rape of Brittany Higgins. During a Senate estimates hearing in 2021, Gallagher claimed she had no prior knowledge of the incident before Brittany Higgins made her shocking claims public in February 2021. However, it appears that Gallagher's own words contradict her statement to the Senate committee.
The truth came to light when Liberal cabinet minister Linda Reynolds, at the time, accused Gallagher of being aware of the allegations two weeks before they were aired on The Project on 15 Feb 2021. In response, Gallagher vehemently denied any knowledge, stating, "No one had any knowledge. How dare you." But recent revelations suggest otherwise.

Ben Roberts-Smith | The Trial of the Century
6/10/2023
Episode 314 - Chad & Niko are joined by Sydney Lawyer, Rowena, to uncover the gripping story of Australia's most decorated living soldier, Ben Roberts-Smith, who recently suffered a devastating loss in the Federal Court after a five-year civil case against three newspapers and three journalists. In 2018, The Sydney Morning Herald, The Age, and The Canberra Times published articles containing allegations of unlawful killings in Afghanistan, SAS bullying, and domestic violence. The war veteran denied all wrongdoing and lodged 14 defamatory claims against the stories.
The most serious accusations, brought forward by publisher Nine Entertainment, implicated the soldier in six unlawful killings. Testimonies from numerous SAS soldiers, offering conflicting accounts of key missions, left the judge with a stark choice between irreconcilable narratives.

Bruce Lehrmann, Brittany Higgins & the Private Leaks
6/9/2023
Episode 313 - Chad, Niko & Liv dive into the latest developments surrounding the allegations made by Brittany Higgins against former Liberal staffer Bruce Lehrmann. In a recent interview on 7NEWS Spotlight, Lehrmann vehemently denied the accusations of rape, providing his own version of events. This marked Lehrmann's first television appearance since Ms Higgins made her allegations public, making it a significant moment for many Australians seeking to hear his side of the story.
Meanwhile, the controversial leaking of private material related to Brittany Higgins has made its way into Bruce Lehrmann's Federal Court proceedings, where the court heard about the publication of an audio recording featuring Higgins, her partner David Sharaz, and two Network 10 journalists, including Lisa Wilkinson, along with text messages sent by Higgins to various parties.
Despite multiple outlets publishing this material over several weeks, the identity of the source remains unclear, adding a layer of intrigue to the ongoing saga. Furthermore, the Coalition is putting pressure on Finance Minister, Katy Gallagher, seeking an explanation for her testimony during Senate estimates. Text messages between Brittany Higgins and her partner, David Sharaz, have been released, suggesting contact with Gallagher days before the story broke, raising questions about the credibility of her evidence before the Senate Committee.

Tickle v Giggle | The Battle for Women's Rights
6/3/2023
Episode 311 - Chad, Niko & Liv are joined by Gender Critical Feminist, Kylie, to examine a legal case that revolves around an Australian transgender woman, Roxy Tickle, who is taking legal action against a female-only social app called Giggle for Girls, along with its founder, Sally Grover. Ms Tickle alleges that she faced discrimination based on her gender identity when she was denied access to the app.
Ms Tickle underwent gender affirming surgery in 2019 and is legally recognised as female on her birth certificate. The Giggle for Girls app is primarily designed for cisgender women but, interestingly, initially accepted Ms Tickle's application. This acceptance was determined by a third-party artificial intelligence system that analysed a selfie she submitted and identified her as a woman.
However, Ms Tickle's access to the app was later revoked by Ms Grover herself, the founder of Giggle for Girls. Ms Grover justified her decision by stating that Ms Tickle was an "adult human male." As a result, Ms Tickle believes that she experienced discrimination based on her gender identity.
What makes this case particularly intriguing is that it had previously been discontinued, but it will now be heard in court. The court will delve into the complexities of the situation, analysing whether the denial of access to the app was indeed an act of discrimination.
This legal battle sheds light on important questions surrounding inclusivity, gender identity, the rights of transgender individuals and the rights of cisgender women. It will undoubtedly have far-reaching implications, not just within the realm of social apps, but for transgender and women's rights as a whole.

The PwC Scandal Exposed
6/2/2023
Episode 310 - In this episode, Chad & Niko delve into a scandal that rocked the financial world and exposed the dubious practices of a renowned multinational consulting firm, PricewaterhouseCoopers (PwC). Join us as we uncover the story of Peter Collins, a former PwC adviser who became embroiled in a web of deceit that undermined the integrity of Australia's tax system.
Back in 2015, Peter Collins, then the international tax chief at PwC's Australian affiliate, found himself in a position of influence. Tasked with assisting the Australian government in designing more robust multinational tax laws, Collins had access to highly sensitive information. However, instead of upholding his ethical obligations and maintaining confidentiality, he chose to betray the trust placed in him.
Collins clandestinely leaked confidential details of the government's plans to PwC personnel both within Australia and overseas. Unbeknownst to the Australian government, this information was exploited by PwC to gain an unfair advantage. With advanced knowledge of impending tax changes, PwC was able to provide early warnings to over a dozen American companies, securing lucrative contracts and potentially denying Australia significant tax revenues.

However, after the speech was uploaded on the court's website, Chief Justice William Alstergren discovered its contents and ordered its removal. As a result, Justice Wilson was compelled to apologise to his colleagues and was prohibited from attending the conference scheduled for September at the International Association of Judges annual general meeting in Taiwan.
Chad, Niko & Kylie discuss how this judge was silenced and why.

How Our ABC Turned Public Interest Journalism into Taxpayer Funded Defamation
5/25/2023
Episode 308 - Secret payments, out of court settlements, numerous breaches of media codes and even their own legislated charter. ABC began as a solution to our corrupted media landscape, only to become the white elephant of public discourse. What follows is a detailed analysis of a legal dispute between an accused rapist, Bruce Lehrmann, and our ABC, over the broadcasting of Brittany Higgins’ allegations at the National Press Club in February of 2022.
Mr. Lehrmann vehemently denies the allegations, and has never been convicted of a crime. He brought defamation proceedings against Network Ten and News Corp, which, at this stage, will go to trial in November. But his case against the ABC is different. Why? And how do we reconcile the ABC’s role as public interest journalist in chief with their repeated failings in areas that they purport to be experts? And, most importantly, if they can’t fulfil their essential mandate, why does the taxpayer continue footing their one billion dollar annual bill?

Is Kathleen Folbigg a Murderer?
5/11/2023
Episode 306 - Australian woman, Kathleen Folbigg, has been in prison for 20 years. She was convicted of killing her four children over a 10 year period in the 90s, and received a 40 year prison sentence in 2003 after her husband found her diaries and handed them over to police, which contained what prosecutors believed to be a confession. Folbigg's trial lasted seven weeks, and it took the jury just 8 hours to convict her of three counts of murder, and one of manslaughter. The prosecution alleged she murdered all four of her children by smothering them during periods of frustration. Rather than relying on scientific and forensic evidence to convict Folbigg, the case relied on the improbability of all four children dying of natural causes - as the infamous Meadow's law maxim goes, “One sudden infant death is a tragedy, two is suspicious and three is murder, until proven otherwise."
The defence argued there was no physical evidence linking the mother to murders - the evidence, according to them, was entirely circumstantial. In fact there was very little consensus among the scientific experts who testified at the trial in 2003.
Fast forward to 2018 - the New South Wales attorney general calls for an inquiry into the convictions to “ensure public confidence in the administration of justice”. Modern science offers alternative explanations for the deaths of Folbigg’s four children. New research suggests that all four of her kids carried genetic mutations that point to deaths by natural causes. A second public inquiry into Folbigg’s convictions has just finished - and the conclusion of this inquiry is that there is reasonable doubt as to Folbigg’s guilt. So what happens now?
Is Kathleen Folbigg a murderer, or was her family just incredibly unlucky? What are the chances of all four children from the same family, all dying from natural causes? And if she isn’t guilty of killing them, why has she been in prison for 20 years? This could be one of the biggest miscarriages of justice in Australian history.

5/4/2023
Episode 304 (FULL) - Roxanne Tickle is suing the app Giggle for Girls and its creator, Sally Grover. Roxy is a transgender woman who claims Sall Grover deliberately removed her from the app because she looked like a man, and wasn’t eligible to join the Giggle app, which was supposedly exclusively for females. Roxy initially made a complaint through the Human Rights Commission, but the matter was terminated due to a low prospect of conciliation. Roxy then took the matter to the federal court, only to discontinue her legal claim shortly thereafter. So, why is this back in court? What happened in between, and why is Roxy Tickle so adamant that she should be allowed onto the Giggle for Girls app?

The New RBA Explained
4/21/2023
Episode 300 (FULL) - The highly anticipated review into the RBA was released this week - there were 51 recommendations, and the government has already committed to pushing through with most of them, in principle, if not all of them. Among the recommendations are a new Monetary Policy board, new committees, new executive positions and more collaboration with public and private sector stakeholders. Most of us would agree that the RBA is broken. It’s not fit for purpose. So, which of these recommendations, if any, address the RBA’s broken mechanism, and how do they propose to fix it?
Chad & Niko assess the merits of these changes and, as usual, help you to read between the lines so you’re up to date and informed over and above the basic headlines.
