However, employers are not required to pay employees when they take leave under FMLA or similar leave laws. In response to the absence of a federal paid leave law, multiple states throughout the U.S. have enacted their own programs to provide employees in their states with paid family and/or medical leave. The challenge is that these mandates differ widely from one another, resulting in a confusing patchwork of benefit and leave policies that creates major compliance challenges for employers that have employees in multiple jurisdictions.
