NARSOL In Action

This two-hour NARSOL conference call took place on September 30. We discussed NARSOL’s new relationship with Paul Dubbeling, an attorney based in Chapel Hill, North Carolina, who is now on retainer with NARSOL. He will be leading our reinvigorated Scarlet Legal Action Project (SLAP). Hour 1: We had an introduction and overview of the Scarlet Legal Action Project and our priorities. Mr. Dubbeling and NARSOL’s executive director Brenda Jones discussed the issues and answered questions. Hour 2: Brenda gave an overview of the upcoming NARSOL national conference. Then Mr. Dubbeling, Brenda, and host Larry took questions related to SLAP and other legal issues and cases from the audience. They were joined by attorney Adele Nichols, who was on the call.

Hour 1: Paul Reingold, an attorney with the University of Michigan School of Law will be our special guest to discuss the recent decision in Michigan. This case has the potential to bar that state from enforcing their registration requirements on those whose conduct occurred before 2011. During the first hour, Atlanta attorney Mark Yurachek will walk us through how the deregistration process works in Georgia. The Georgia process is open to more offenders than other states that permit removal via a similar procedure. In addition, Mr. Yurachek will provide a brief update on the Halloween lawsuit NARSOL plans to file in Georgia prior to Halloween. Mr. Yurachek is the lead attorney for the Halloween challenge and has handled many removal petitions in northern Georgia. The second hour will be Can They Do That? with Ashley Cloud. Ms. Cloud is the staff attorney for our NARSOL affiliate in New Mexico. This is your opportunity to ask an attorney if something can be done from a constitutional perspective. The subject matter is relevant to everyone, regardless of what state you live in. For example, Arkansas just enacted Halloween restrictions which will be enforced this year. Several towns in Texas have them and more are considering them. We all should keep in mind that just because your state does not have something now does not mean it can’t enact it in the future.

We will focus on litigation plans in New Mexico. Our guest during this hour will be Ashley Cloud who will soon become staff attorney for Liberty & Justice Coalition, NARSOL'S New Mexico affiliate. Ms. Cloud is a former prosecutor who has now decided to join our cause, and we want to welcome her. Ms. Cloud will briefly describe the challenges she is planning in the coming months.

We will examine a newly enacted statute in Tennessee which would have forced parents to leave their homes had it not been blocked by a federal judge. We have invited one of the attorneys involved in the litigation on with us. He indicated that he may not be able to attend and that his participation is dependent on what the judge does in the preliminary injunction hearing which will be held earlier in the day.

We plan to discuss NARSOL's upcoming challenge in Georgia regarding the forced placement of signs in registrants' doors or yards on Halloween. Mark Yurachek who is leading that litigation will be with us during this hour.

The 3rd hour, we will have several members of the board of directors on the call, so this is your opportunity to ask about our work.

This is an hour of Can They Do That? We will be joined by King Alexander, a supervising felony without parole attorney in the Calcasieu Parish Public Defender’s Office. This is your opportunity to ask a veteran attorney whether or not something can be done legally or if it potentially violates the constitution.

This call will focus on Murphy v. Raoul, a recent decision by the United States District Court for the Northern District of Illinois, which found that the state is trampling the constitution by failing to release those who have served their full sentences. We discuss how the deregistration process works in Colorado. Ms. Kelley has successfully handled deregistration petitions throughout the state.

We have a full hour of Can They Do That? People often wonder if their supervising PO or registry tracking officer can impose a particular requirement or if their demands may be unlawful. Ms. Kelley and Larry answer such questions.
