Today it's a mixed bag for legal stories: 1. The New York appellate court reimposed the gag order Judge Engoron placed on Donald Trump in an effort to stop Trump from endangering the court staff. Glenn thinks the gag order should be broader. 2. Newly disclosed text messages between Rep. The Donald Trump gag orders are beginning to cross-pollenate. After Trump posted attacks on Judge Engoron's law clerk in New York, hundreds of threats poured in from Trump's supporters. Special Counsel Jack Smith packaged up the evidence of those threats and filed the information with the appellate court in DC that is deciding the constitutionality of the gag order imposed by Judge Tanya Chutkan in Trump's federal prosecution in DC. Last week, Colorado Judge Sarah Wallace entered a finding that Donald Trump engaged in an insurrection on January 6, 2021. However, Judge Wallace went on to rule that the 14th Amendment does not disqualify a president who engaged in an insurrection from again serving as president of the United States. Both parties have now filed appeals in the case. Trump has appealed the judge's finding that he engaged in an insurrection, and Crew - the organization that brought the suit on behalf of Colorado voters - appealed her ruling that Trump is not disqualified by the 14th Amendment. Glenn says one of the important factors in assessing the likely result on appeal involves the different standards of review that are applied to a trial court's factual determinations versus its legal determinations. Then, if you thought the New York fraud trial couldn't get any worse for Donald Trump - it just did. In a colossal tactical blunder, Trump's own lawyer put a witness on the stand that, as the Business Insider reported, "ties (Trump) to the conspiracy." Trump's lawyers called as a witness longtime comptroller for the Trump Organization Jeffrey McConney. After Trump had previously testified that he knew little to nothing about the annual net-worth statements of his own business, McConney testified that the statements were actually provided to Trump for his final review. Indeed, the attorney for the New York Attorney General's office cross-examined McConney with his own hand-written note on the financial documents that plainly stated, " DJT to get final review." A Colorado judge has ruled that the evidence presented during the course of a trial proves that Donald Trump engaged in an insurrection against the United States. Judge Sarah Wallace spends 95 pages of her 102-page ruling meticulously detailing the evidence supporting her findings that Trump did indeed engage in an insurrection. But in the last pages of her ruling, she says that while there "are persuasive arguments on both sides" of the disqualification issue, "it appears to the Court that for whatever reason the drafters of Section Three (of the 14th Amendment) did not intend to include (for disqualification purposes) a person who had only taken the Presidential Oath." And accordingly, Judge Wallace declined to find that Trump was disqualified from holding office in the future. One of the two gag orders judges have imposed on Donald Trump in attempts to protect witnesses, court staff and prosecutors, has been stayed or paused by the DC appellate court pending an oral argument scheduled for November 20th. As the reporting indicates, each of the three appellate court judges who will sit on the panel for the gag order appeal was appointed by a democrat president. In the age of Trump, we are always asking the question, "who appointed this federal judge?" But it hasn't always been that way. In today's longform weekend podcast - Glenn recaps some GOOD NEWS stories of the week - starting off with a fresh new story about DC Judge Tanya Chutkan - who is already preparing for Donald Trump's trial on March 4th. As just reported by the Washington Post, Judge Chutkan will now begin jury selection in Trump's DC case on Feb. 9. This reinforces that Chutkan's trial "will not yield to an election cycle," which she stated in open court when Trump's lawyers asked her to continue the trial until after the Nov. 2024 presidential election. The next good news story: Gag-order-palooza for the month of October. It started with a NY judge gagging Trump and the month ended with a DC judge gagging Trump. All-in-all, a pretty good month. Glenn says the big question is - what will happen to Trump when he violates the gag orders? Next, Glenn gives updates on Trump's NY fraud trial: Don Jr. and Eric provide foolish and incredible testimony, while Ivanka's upcoming testimony may be the most perilous for her father and her brothers. And more good news, in Colorado, a trial has begun to determine if Trump is ineligible to be put on the presidential ballot in that state because he is disqualified under the 14th Amendment for engaging in an insurrection AND because he continues to give aid and comfort to the insurrectionists. Glenn asks: if he is found to be disqualified - will Trump's appeal to the Supreme Court be his ace in the hole? O.K. Last good story, during a campaign rally - Donald Trump made fun of Mike Pence for dropping out of the presidential race; but he still remains an important witness. Glenn explains Pence will get the last word, if not the last laugh, when he testifies as a directly and sharply incriminating prosecution witness at Trump's upcoming criminal trials.
